TERMS AND CONDITIONS OF SALE

1. GENERAL PROVISIONS

1.1. These Terms and Conditions (hereinafter referred to as “Terms and Conditions”) apply when a consumer (hereinafter referred to as “Customer”) places an order on the website www.wallbonito.com and/or other related websites (the “Website”). The Terms and Conditions apply only to customers who are private persons. The Service Provider running an online store available at www.wallbonito.com is RSQ Associates Sp. z o.o. with its registered office in Warsaw (03-966) Afrykańska Street no 14/94, entered into the Register of Entrepreneurs of the National Court Register by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register, under the number KRS 0000763353, NIP 1132990603, REGON 382086103 (hereinafter referred to as “Wallbonito” or “Store”). 1.2. The Terms and Conditions constitute the Terms and Conditions referred to in Article 8 of the Act of 18 July 2002 on the provision of electronic services (i.e. Journal of Laws 2017.1219 as amended).

1.3. Before placing an order in the Store, the Customer is obliged to read these Terms and Conditions. Placing an order in the Store is tantamount to the Customer becoming familiar with the Terms and Conditions and accepting their provisions in the wording as of the date of placing the order.

1.4. All images presented on the website should be treated as illustrative illustrations, which may ultimately vary slightly in colour.

1.5. The website and all its content is owned by Wallbonito or its licensors. All information is protected by intellectual property law and marketing regulations. This means that trademarks, product names, company names, designs, images and graphics, layout and information about products, services and all other content may not be copied or used without the prior written consent of Wallbonito.

2.      PLACING AND EXECUTING ORDERS

2.1. An order is placed by the Customer in electronic form through the Website and constitutes an offer to conclude a contract of sale of products placed on the Website of the Online Store for the price specified therein.

2.2. When placing an order, the customer is asked to provide some personal data. The customer confirms that all information provided is correct and complete and that he bears responsibility for any errors in the data provided. Information on the processing of personal data by Wallbonito can be found in Wallbonito’s Privacy Policy, which is an integral part of these Terms and Conditions.

2.3. By registering and/or placing an order, the Customer gives his separate consent to the processing of his personal data by Wallbonito in order to record sales and order execution, in accordance with Regulation 2016/679 of the European Parliament and of the Council (EU) of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC, national data protection laws and the adopted Privacy Policy.

2.4. The Store reserves the right to withdraw from the order if the data provided by the customer in the order form is incomplete (no name, surname, address, e-mail address or telephone number), or if the data provided by the customer is incorrect.

2.5. The customer undertakes to ensure that no one else uses his or her login details. The Customer has no right to disclose his user name or password to anyone and must ensure that all documents with user name and password information are stored in a manner that prevents access to them by unauthorized persons! The Client shall immediately notify Wallbonito if there is a suspicion that an unauthorized person has gained access to the Client’s password. If the Client does not notify Wallbonito about it, he is responsible for all purchases made using his login data.

2.6. If Wallbonito will suspect that the Customer is using your user account inappropriately or login data or otherwise violates the Terms and Conditions, Wallbonito has the right to block the Client’s access to his/her user account. Wallbonito also has the right to assign new login data to the customer.

2.7. The order is accepted for processing when Wallbonito confirms the order. The order is considered to be confirmed when the money is paid and credited to Wallbonito account. The customer receives confirmation of the order in the confirmation e-mail. At this point, a sales contract is concluded.

2.8. The order completion date may be changed if Wallbonito  wait too long for confirmation or payment for order.

2.9. The buyer can make changes to the order until Wallbonito sends information about accepting the order for processing. Making changes is possible by sending an e-mail to orders(at)wallbonito.com.

2.10. The products placed on the website are included in the Store current commercial offer.

2.11. The price is expressed in PLN or EUR or GBP depending on the Customer country.

2.12. The order dispatch date is counted in working days.

3. PAYMENT AND  DELIVERY

3.1. The only form of payment for an order is a prepayment of 100% of the total price.

3.2. The Customer payment may make by selecting one of the following variants:

3.3. The online payment provider is Blue Media S.A. or PayPal.

3.4. In case of return funds for a transaction made by the Client with a payment card,  the funds are returned to the bank account assigned to the Client payment card.

3.5. The order processing time is counted from the day the funds are credited to the Wallbonito account.

3.6. Orders are sent by Wallbonito via courier to the address indicated by the Customer when placing an order.

3.7. The Customer should pay special attention to the condition of the consignment upon receipt, in particular whether the consignment has not been damaged or destroyed.

3.8. Wallbonito is not responsible for delays in the delivery of shipments by courier companies. Claims related to mechanical damage of the parcel during transport will accepted only after receiving a damage protocol signed by the consignee and the parcel supplier.

3.9. Changing the shipping address in your account does not change the shipping address for orders placed before this change is made. The order will sent to the address provided when placing the order.

3.10. Changes to the shipping address for already placed Orders can only be made by email contacting Wallbonito (mail: orders(at)wallbonito.com).

3.11. In case the package was not collected by Customer and returned to Wallbonito, a fee of 35 € equivalent will be charged to Customer.

3.11.1. This covers shipping to and from Customer, as well as handling and restocking of products.

3.11.2. The above fee will be deducted from Customer’s refund.

4. RIGHT OF WITHDRAWAL

4.1. A consumer who has concluded a sales contract with an online Store may withdraw from The online Store without giving reasons by making a written declaration within 14 days of the date of delivery of the purchased item and informing Wallbonito beforehand.

4.2. The statement of withdrawal should include in particular the order number, the date of its submission, the date of receipt of the products, and an indication of the form of return of the price paid.

4.3. In the event of withdrawal from the contract, the contract shall be deemed not concluded. What the parties have provided is returned unchanged.

4.4. If the right of withdrawal is exercised, the Customer is responsible for the condition of the product at receipt and during the return shipment.

4.5. The return should be made – at the Client’s expense – immediately, no later than within 14 days. „Cash on delivery” shipments not accepted by the online Store.

4.6. No additional shipping costs resulting from the Customer’s choice of an option other than standard delivery offered by Wallbonito shall be refunded.

4.7. Shipping costs to the customer are only refundable if the entire order is returned. In case of returning part of the order, the cost of shipping to the buyer is not refundable.

4.8. The refunds are made by transfer to the account indicated by the buyer.

5. COMPLAINTS 

5.1. The complaint must be made in writing.

5.2. The right to make a complaint applies to defective products in accordance with applicable consumer protection regulations. A customer who wishes to exercise his right of complaint with respect to any product ordered should contact Wallbonito as soon as possible after the defect is detected, using the contact details provided on the website.

5.3. Before sending the products, the buyer should contact the Wallbonito in order to set a deadline for sending the products.

5.4. The claimed products should be sent in packaging, which must guarantee adequate protection during transport.

5.5. The costs of shipping and insurance of the products under complaint shall be borne by the buyer. The Wallbonito not accept parcels sent back on delivery.

5.6. The Store shall inform the Buyer about the acceptance or rejection of the complaint within 14 days from the receipt of the complaint package.

5.7. The products under complaint shall be sent back to the buyer within 7 days of the complaint being considered. If the complaint is accepted, the cost of delivery shall be covered by the Store. If the complaint is not accepted, the cost of delivery is covered by the buyer.

5.8. Claims related to mechanical damage of the parcel during transport will accepted only after receiving a damage protocol signed by the consignee and the parcel supplier.

6. EXTRA-JUDICIAL MEANS OF PROCESSING RECLAMATIONS AND CLAIMS

6.1. Detailed information concerning the possibility for a Customer who is a consumer to use out-of-court methods of complaint handling and redress and the rules of access to these procedures are available in the offices and on the websites of poviat (municipal) consumer advocates, social organizations whose statutory tasks include consumer protection and Voivodeship Trade Inspectorates.

6.2. A customer who is a consumer has, among other things, the following possibilities to use out-of-court complaint handling and redress:

6.2.1. The Customer is entitled to apply to apply to a permanent amicable consumer court to resolve a dispute arising from the Purchase,

6.2.2. The Client is entitled to apply to apply to the Provincial Inspector of the Commercial Inspectorate, with a request to initiate mediation proceedings to amicably end the dispute between the Buyer and the Seller,

6.2.3. The Customer may obtain free assistance in resolving a dispute between the Customer and the Wallbonito, also using the free assistance of the district (municipal) consumer advocate or social organisation whose statutory tasks include consumer protection. e.g. Consumer Federation( Polish Consumer Association).

7. LINKS

Wallbonito may provide links to other websites that are beyond its control, and websites that are beyond Wallbonito is control may provide links to this website. Although Wallbonito endeavors to provide links to websites with similar privacy and security policies as those set forth in Wallbonito’s privacy policy, Wallbonito is not responsible for protecting the confidentiality, information or personal information provided by the Client on other websites. The Client should exercise caution and read the records of personal data on individual web sites.

8. FORCE MAJEURE

Wallbonito shall not be liable for delays resulting from circumstances beyond its control, for example, labor disputes, acts of war, fire, lightning, terrorist attacks, changes in governmental orders, technical problems, power failures, telecommunications, computer or other communications, defects or delays in the performance of services by its subcontractors due to the aforementioned circumstances. Such circumstances shall result in exemption from compensation or other measures. In the event of any such situation, Wallbonito will inform the Customer both at the time it occurs and after it ceases. If such a situation persists for more than 30 days, both the Customer and Wallbonito are entitled to terminate the purchase agreement with immediate effect.

9. PERSONAL INFORMATION IN THE WALLBONITO

9.1. Wallbonito is a controller of personal data of a Client who is a natural person within the meaning of Regulation 2016/679 of the European Parliament and of the Council (EU) of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.

9.2. Customer – an individual who, at the time of registration in the online Store and/or placing an order, consents to the processing of his or her personal data by Wallbonito, in accordance with applicable laws, in particular the Personal Data Protection Act and the Act on Provision of Electronic Services.

9.3. The personal data provided shall be processed by Wallbonito exclusively for the purpose of proper performance of the sales contract.

10. FINAL PROVISIONS

10.1. The Terms and Conditions shall enter into force on 07.01.2020.

10.2. The Wallbonito has the right to change the Terms and Conditions. Amendments to the Terms and Conditions come into force on the day of placing the amended Terms and Conditions on wallbonito.com website.

10.3. In matters not regulated by the above Terms and Conditions, the relevant provisions of the Civil Code shall apply.

10.4. These Terms and Conditions are made available to buyers free of charge via wallbonito.com website in a form that enables its downloading, recording and printing.

10.5. Agreements concluded via the Wallbonito are concluded in Polish. Other language versions of the Terms and Conditions constitute only a translation of the Polish text, and in case of discrepancies in the understanding of the provisions of individual language versions, the Polish text  shall be decisive for the interpretation of the terms in the Agreement or “Terms and Conditions of sales”.
